Penal Code 264.1 – (Gang) Rape in Concert

Penal Code 264.1 PC states that anyone who engages in an act of sexual intercourse with another person against that person’s will, and the act is accomplished by two or more persons in concert, may be charged with gang rape. The key element of this offense is that the act of rape is committed by multiple individuals working together.

Gang rape is considered a serious offense with severe consequences. In California, gang rape is generally prosecuted as a felony.
