Penal Code 264.1 PC states that anyone who engages in an act of sexual intercourse with another person against that person’s will, and the act is accomplished by two or more persons in concert, may be charged with gang rape. The key element of this offense is that the act of rape is committed by multiple individuals working together.
Gang rape is considered a serious offense with severe consequences. In California, gang rape is generally prosecuted as a felony. The penalties for a conviction of gang rape can include imprisonment in state prison for a lengthy period of time, significant fines, mandatory counseling, and the requirement to register as a sex offender.
