Robbery: Penal Code 211 defines robbery as the act of taking someone else’s personal property from their immediate possession and presence, against their will, through the use of force or fear. Robbery typically involves the element of taking someone’s property by means of direct physical force or by instilling fear in the victim.

Elements of the Offense: To prove the crime of robbery, the prosecution generally needs to establish the following elements:

a. Taking of Personal Property: The defendant took another person’s personal property. This property can be tangible items like money, jewelry, or electronics.

b. Immediate Possession and Presence: The property was taken from the immediate possession and presence of the victim. It typically means the property was within the victim’s control or in close proximity.

c. Against the Victim’s Will: The property was taken against the victim’s will, without their consent.

d. Use of Force or Fear: The defendant used force or fear to accomplish the robbery. Force refers to physical violence or threats of violence, while fear involves instilling a reasonable fear of harm in the victim.

Degrees of Robbery: California recognizes two degrees of robbery:

a. First-Degree Robbery: Robbery is considered first-degree when it involves certain aggravating factors, such as robbing someone in a dwelling, on public transportation, or from the person of someone who is elderly or disabled.

b. Second-Degree Robbery: Robbery that does not meet the criteria for first-degree robbery is generally classified as second-degree robbery.

Penalties: Robbery is a serious offense in California. The penalties for robbery can vary depending on factors such as the degree of the offense, the use of weapons, the presence of prior convictions, and other aggravating circumstances. Convictions for robbery can result in significant prison sentences, fines, and potential other consequences.
